Pakistan Muslim League (PML-Q) President Chaudhry Shujaat Hussain on Monday ruled out the possibility of impeachment of President Musharraf, saying the ruling coalition would never go for it.
Addressing a press conference here, he said no one is in a position to impeach the president. He said the PML-Q would never accept removal of any judge even for a brief period and would support all legal efforts made for the solution of the judicial crisis.
He said the postponement of the by-elections could benefit Shahbaz Sharif who, he alleged, was a defaulter of billions of rupees. He said the move could enable him to pay back his loans. Opposition leader in the National Assembly Chaudhry Pervaiz Elahi and senior leaders of the PML-Q including Chaudhry Amir Hussain, Nisar Memon, Raja Basharat, Chaudhry Zahiruddin, Arshad Khan Lodhi and others, were also present on the occasion.

The Election Commission of Pakistan in a surprise move on Monday once again postponed the by-elections for two months and announced August 18 as the new date for the electoral exercise.
The commission cited prevailing law and order situation in the country and the upcoming annual budget sessions of the National Assembly and the four provincial assemblies as the main reason for the delay.
However, when contacted, Commission Secretary Kanwar Muhammad Dilshad told The News that Chief Election Commissioner Justice (retd) Qazi Muhammad Farooq could review the postponement decision after reassessing the security situation and evaluating the political parties’ feedback.
The secretary pointed out that the decision was taken in view of the NWFP interior secretary’s report, in which a grim picture of law and order was painted. Dilshad said the new election schedule would be announced shortly. However, candidates who had already filed their nomination papers were not required to repeat the exercise.

The Election Commission’s announcement to put off the by-elections has created cracks in the new ruling coalition.
The main partner of the ruling coalition in the NWFP has claimed that the delay in the by-election was masterminded by the adviser to the prime minister on interior affairs. The Awami National Party (ANP) has come out with a clear stand against the Prime Minister’s Adviser on Interior Affairs Rehman Malik and claimed that it was he who forced the provincial government to give in writing that the security situation in the province was not suitable for the by-elections.
PPP Co-chairperson Asif Ali Zardari condemned the announcement made by the Election Commission and Federal Information Minister Sherry Rehman termed it a conspiracy against democracy.
Zardari informed The News late night that he will meet Prime Minister Yousuf Raza Gilani on May 6 (today)and request him to hold election in June and not in August this year. The PPP co-chairman said the prime minister will give you a good news tomorrow and the whole controversy would be over.

“The president would not give his assent to the executive order notifying return of the deposed judges after the passage of the proposed resolution by the National Assembly if he was not taken on board,” an official told The News.
Even if Prime Minister Syed Yousuf Raza Gilani issued an executive order to restore all the deposed judges it still requires the president’s nod to take effect. The official said under the Constitution judges’ appointments were made in the Supreme Court by the president on the advice of the prime minister that comes “after consultation with the chief justice of Pakistan”.
An expert referred to Article 48, which says “in the exercise of his functions, the president shall act in accordance with the advice of the cabinet (or the prime minister)” except in cases where the president has discretionary powers.
However, one set of constitutional experts was of the firm view that the president is bound to act just as a post office in the judicial appointments, meaning that he has to accept the advice of the prime minister as it is. The president has no independent powers whatsoever not to go by the premier’s recommendations, they say.

Supreme Court Bar Association (SCBA) President Chaudhry Aitzaz Ahsan filed his nomination papers for NA-55 seat here on Monday amid scuffle between two groups of lawyers.
The scuffle broke out when Sajjad Akbar Abbasi advocate pointed out that the lawyers’ community and political parties including Jamaat-e-Islami chief Qazi Hussain Ahmed, Pakistan Tehrik-e-Insaf chief Imran Khan and others had boycotted the general elections on the call of Aitzaz Ahsan but now he was taking part in by-elections. He asked Aitzaz Ahsan not to take part in by-elections.
“If Aitzaz takes part as an independent candidate in by-elections, lawyers would cooperate with him, but if he tries to contest the polls from the PPP platform they would not cooperate with him. The attitude of PPP Co-chairman Asif Ali Zardari is not good with the lawyers’ community on the judges’ issue; therefore, they would not cooperate with Aitzaz in the by-elections,” he said.
